RETURNS – TERMS & CONDITIONS


The following Terms and Conditions of Sale applies to all items we sell, and the Purchaser (Buyer) agrees to all terms below by making any purchase from the aminis.com website or store locations:


We make arrangements to reserve stock from other customers and prepare items for shipment as soon as they ordered. Therefore, an order yet to be picked up, shipped or delivered must be canceled in writing via email to [email protected] within 24 hours of purchase to receive a full refund.


If you wish to return your merchandise for any reason:

  • Cancellation and returns authorized by Amini's Galleria, Inc. will be subject to a minimum 25% restocking fee and the cost of shipping and return shipping.
  • Once an item has shipped, refusal to take delivery of products will result in a refund of 50% of the purchase price, less applicable shipping and storage costs both ways.
  • The merchandise must be in original, uninstalled condition including original box, packaging manuals and accessories.
  • All refunds will be processed within 14 days. In some cases, you will receive a refund sooner depending on the time it takes for the freight company and bank processing. We will notify you via email on the details of your refund, and issue your refund in the form of payment used to make your purchase.
  • "As-Is" and "Closeout" Items are not covered by warranty.

You are responsible to pay the shipping and handling costs both ways plus a restocking fee when you return an order for any of the following reasons:

  • You refuse a delivery without inspection.
  • You miss a delivery appointment (or you can contact our In-House Shipping Team to pay for redelivery to your home).
  • You return a non-defective or un-damaged product.

*Shipping cost generally ranges from $150 to $1,000 or more depending on size and weight.


SPECIAL ORDERS/INCOMING STOCK/DELIVERY GOODS

Warehouse receiving dates are the best estimates we can provide given production and transportation information we receive from the manufacturer. The manufacturer may not always give accurate shipping information. ANY WAREHOUSE RECEIVING OR SHIPPING DATE IS AN ESTIMATE AND THEREFORE IS NOT GUARANTEED

INSPECT YOUR PURCHASE AND MEASURE YOUR MERCHANDISE!

Your signature is your acknowledgment your merchandise is satisfactory as picked up, ordered and/or delivered. You accept responsibility for items as soon as they are picked up by you or delivered as well as for fitting into the home and you are financially responsible for any modifications necessary to get the items into the home. Special order items on delivery that so not fit into the home for any reason cannot be returned. You agree to accept sizes and configurations as itemized on the invoice and that what is written supersedes any verbal conversations. At the time of delivery, you are responsible to have someone present to approve the exact placement of product and approve condition. A signature by you or a representative that you appoint at time of delivery is in effect your approval of product placement and condition. Unless it is a legitimate warranty claim, there will be a charge for any return visit.

  • In the event that there are any minor blemishes, scratches or dents in delivered merchandise, you agree to inspect for those at time of delivery prior to signing delivery receipt and will reasonably allow Amini's and/or a furniture repair service to attempt a repair prior to the order of a replacement.
  • No two pieces of leather or furniture are alike. As such, natural markings and grain variations are not considered defects and you accept terms as such. Additionally, duet to the nature of wood grain, metal, lighting and glass, color and finish may deviate and samples do not guarantee an exact color match.
  • Finish on outside fixtures may tarnish or discolor over time. This is generally not considered a defect. In case of a finish problem with an exterior fixture, the manufacturer's decision regarding corrective action, if any, will be determinative.

Product Set Up:

Please note that some items on our web site require some assembly. Most items sold by us also require a small amount of "setup time", which instructions are provided for via game manuals and on our website. We cannot be held responsible for any damage to items due to improper setup. In the event that setup is provided by Amini's Galleria, Inc. or its authorized representatives, we assume no responsibility for damage to the item or the premises in which the items is being delivered. This includes damage to walls, doors, doorways, flooring, and any other places where such damage might occur during deliver and setup.

Prices:

Prices published by us or quoted by our representatives may be changed at any time without notice. Due to fluctuating market conditions, written quotations expire automatically 24 hours from the date issued and subject to change or termination with verbal or written notice during that period. All quotations and prices are subject to adjustment on account of new specifications, modifications, quantities, shipment methods or other terms and conditions which are not part of the original price quotation.

Collections:

  • If any dispute arises out of this agreement due to the breach of the purchaser and legal proceedings becomes necessary, purchaser agrees to be responsible for any cost incurred, included, but not limited to, attorney's fees and court costs.
  • Payments not made when agreed will bear interest at the maximum rate allowed by law.
  • In the event an item on the original order is modified or substituted and agreed to in writing, text, or email by both parties, then the original terms and conditions agreed to apply and are not voided. This is not a counteroffer to the original agreement and purchase. Purchaser understands and agrees that one item on an order is not related to another item when modified, substituted, or dropped.

AGREEMENT TO TERMS:

The purchaser (Buyer) confirms that they have read, and agrees to, all terms, conditions and store policies listed in this document.

The Purchaser (Buyer) agrees that this agreement and all transactions hereunder, or any dispute or controversy arising out of, relating to, or in connection with any purchase, transaction, agreement, or its interpretation, with Amini's Galleria, Inc. shall be governed by the laws of the State of Missouri, County of Saint Louis, and agrees that in the event of Federal or State court litigation, all cases will be filed, conducted and heard within the State of Missouri, County of Saint Louis.
